Jennifer Weinstein, Assistant Vice President, Management Liability Claims, will be a panelist on the upcoming May 12 Webinar entitled “Navigating the Pitfalls and Challenges of COVID-19 and the Post-Quarantine Workplace.”
Moderated by Mercedes Colwin, Founding Partner, GRSM New York Office, the panel will focus on the changes that are expected in the work force as the country emerges from shelter in place ordinances, including measures that employers are expected to implement to safeguard employees. The panel will analyze the various screening measures and the attendant pitfalls of such actions. This panel will also discuss the claims on the horizon stemming from adverse employment actions taken in response to the economic shutdown.

The annual CLM Conference is the premier event for those in the claims and litigation management industry. This year, attendees from Government Risks, Healthcare Group and Management Liability are representing OneBeacon as panelist presenters at the conference in Houston, TX.
Daniele Freaner, who is part of OneBeacon Healthcare Group claims, is part of a presentation titled, “Danger Zone: Healthcare Liabilities Associated with Natural Disasters.” This session will identify the liability risks faced by healthcare providers or entities that can arise in natural disaster emergency situations, discuss ways to minimize those risks and provide possible defenses.
In the session titled, “A Higher Education for All: Title IX, Title VII and the New Administration,” Management Liability claim’s Jennifer Weinstein will be part of a panel that will discuss the new Title IV regulations and guidelines issued by the current administration, the evolving case law in this area, the conflicts with other sexual assault and discrimination laws and the impact on claims and their resolution. The session also will discuss what underwriters should watch for in light of the recent changes.
Government Risks’ Sarah Schmitz will participate in the session titled, “The Crossroads of Coverage, Liability and Sovereign Immunity.” Policies issued to governmental entities often state that the purchase of the policy is not a waiver of the entities’ sovereign immunity. Speakers will discuss what happens when plaintiffs challenge whether such language in the policy preserves the sovereign immunity, how courts have handled those challenges and practical tips for how to handle such situations.

The 2nd annual Title IX ExecuSummit is taking place this year from July 25-26 in Uncasville, CT, and OneBeacon Management Liability Claim’s Jennifer Weinstein is participating on a panel titled, “Predictions for Title IX Under the New Administration – President Trump & Secretary DeVos.”
The panel will discuss Title IX issues and how they expect President Trump and Secretary DeVos to handle them. They will highlight anticipated differences between the focus of the prior and current administrations. The panel will also discuss appropriate ways to help protect against suits involving these issues, including various insurance policies and best practices. In addition to participating on the panel, Jennifer is also a co-chair of this year’s Title IX ExecuSummit.
On July 27, she will head up to Boston for the 2017 CLM Management & Professional Liability Conference, where her panel discussion will focus on “Dramatic Shifts in the Legal and Regulatory EPL Landscape Under the New Administration and the Pathway Forward (EPL).”
As priorities of the current administration take shape, dramatic shifts in legal and regulatory focus are sure to have a profound effect on the employment practices liability landscape. This session will explore developing issues facing management in 2017, including how changes to the Supreme Court, the NLRB and the various federal agencies are likely to impact emerging issues such as marijuana in the workplace, transgender employees and website and technology accessibility for the disabled. The panel will provide their insights into best practices for claims investigation, litigation strategy and discuss recent developments in the law.

The False Claim Act (FCA) is the primary means to fight fraud perpetrated against the government. The FCA imposes civil and criminal liability for knowingly making a false or fraudulent claim to the United States for money or property; or to avoid an obligation to pay money (reverse false claim). 31 U.S.C. §§ 3279-3733.
FCA claims have been on the rise as the government, in collaboration with other governmental agencies, continues to crack down on fraud, waste and abuse in order to protect valuable taxpayers’ dollars. Thus, the key is to be proactive in managing the risk before an FCA claim is made against you.
